These Terms of Service are an agreement between you and Soda Interactive Limited ("we", "us"), a company registered in England and Wales and the operator of the Hoshy app. They also serve as the end-user licence agreement (EULA) for Hoshy on the App Store. By creating an account or using the app, you agree to these Terms. Our Privacy Policy explains how we handle your data.
You must be at least 13 years old to use Hoshy. If we reasonably believe an account belongs to a child under 13, we may close it. In some countries the age for agreeing to online services on your own is higher (up to 16 in parts of the EU) — if that applies to you, you need a parent's or guardian's permission. You are responsible for keeping your sign-in credentials secure.
You can create an account with an email address and password, or with Sign in with Apple. You agree to provide accurate information and not to impersonate anyone. Section 13 explains when we can suspend or close accounts.
Hoshy helps you build daily habits: habit tracking, daily check-ins, a private journal, reminders and notifications, streaks and a Consistency Rank, and social features — friends, accountability buddies, comments, likes, kudos and nudges, buddy discovery and search, and leagues that group you with other users worldwide who may not be your friends. Hoshy is for your personal, non-commercial use. Features evolve over time (sections 12 and 17).
You own the content you create in Hoshy — your username, bio, profile photo, habit names, habit photos, comments, messages, check-ins, and journal entries. So we can run the app, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content, only as needed to operate and provide the service.
In practice that means: friends, buddies, and league members see your activity and daily cards; any signed-in user can see your basic profile (username, photo, bio, rank, badges) and — if buddy discovery is on — your habit list and join date in matching and search; and your username and habit names appear in other users' notifications, delivered via Apple. Photos are stored at unguessable links that don't require a login. Your privacy settings let you limit many of these surfaces — the Privacy Policy explains exactly who can see what.
You promise you have the rights to what you post and that it doesn't break section 6. The licence ends when you delete the content or your account, except for copies already delivered to other users and as described in section 14.
We have no tolerance for objectionable content or abusive behaviour. You agree not to:
We may remove content and suspend or terminate accounts that break these rules.
You can block any user — blocked users can't see your profile or interact with you. To report content or a user, email hello@sodainteractive.co.uk with the username and what happened; we review every report promptly and act where needed, including removing content and suspending accounts.
We don't pre-screen content. Moderation is carried out by our team in response to reports and our own observations, case by case, without automated decision-making. If we remove your content or restrict your account, we'll tell you what was affected and why, and you can contest the decision by replying.
Hoshy offers two optional auto-renewing subscriptions: Hoshy Premium Monthly (1 month) and Hoshy Premium Annual (1 year). Prices are shown in the app and the App Store in your local currency.
Premium currently includes: tracking up to 5 habits (3 free), all sky themes, your full journal and profile history (free accounts see the last 7 days of journal), advanced check-in insights, custom card styles, and streak freezes — up to 3 per calendar month, usable on missed days within the last 7 days. Unused freezes don't roll over and have no cash value. The feature set may change over time (section 17).
If your account was among approximately the first 100 to complete onboarding, it has Founder access: every Hoshy Premium feature, free, for as long as your account and Hoshy exist. Founder access tracks the current Premium feature set as it evolves. It is personal to your account, can't be transferred, exchanged, or refunded, and has no cash value. It ends only if you delete your account, Hoshy is permanently discontinued, or we revoke it for a serious breach of these Terms (such as fraud or creating multiple accounts to game the offer) — and if we ever do that, we'll tell you why.
Future promotions may have their own rules, can be limited per person, and may be changed or withdrawn before you accept them.
The app, its design, branding, and all original content are owned by Soda Interactive Limited. You may not copy, modify, distribute, or reverse-engineer any part of the app, except to the extent permitted by applicable law.
If you believe content in Hoshy infringes your copyright or other rights, email hello@sodainteractive.co.uk with: the work concerned, where the material appears (username or screenshot), your contact details, and a good-faith statement that the use isn't authorised. We may terminate the accounts of repeat infringers.
We provide the service with reasonable skill and care, but we don't guarantee uninterrupted or error-free operation — we may take the app offline for maintenance and updates, and experimental features may change or be removed. We may change or withdraw features over time; if a change would materially disadvantage you, we'll give you reasonable advance notice. If we ever permanently discontinue Hoshy during a paid period, you can seek a refund for the unused time through Apple.
You can stop using Hoshy or delete your account at any time (section 14). We may suspend or terminate your account immediately for a serious breach of these Terms — zero-tolerance content, fraud, or illegal activity — or otherwise on reasonable notice. If we do, we'll tell you what happened and why, except where the law prevents us. On termination your licence to use the app ends; sections that by their nature should survive (including the content licence as scoped, liability limits, governing law, and the Apple provisions) survive.
You can delete your account in the app at any time. This removes your profile, habits, completions, check-ins, journal, photos, social connections, feedback records, device tokens, and subscription records from our systems. A few things may persist: notifications already delivered to other users that mention your username, support emails (deleted on request), and pseudonymous analytics. If an uploaded photo fails to be removed automatically, contact us and we'll delete it.
"Reset All Data" is different from deletion — it clears your content but keeps your account, username, subscription, and journal entries. Deleting your account does not cancel an active subscription — cancel separately in Settings > Apple Account > Subscriptions. See the Privacy Policy for full details.
Nothing in these Terms affects your statutory rights as a consumer — including, under the Consumer Rights Act 2015, the right to digital content that is of satisfactory quality, fit for purpose, and as described — or any rights under the mandatory laws of the country where you live.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded under applicable law.
Subject to that: we are not liable for losses that were not reasonably foreseeable when you accepted these Terms, or for business losses — Hoshy is for personal use. Our total liability to you is limited to the greater of the amount you paid us through the app in the 12 months before the claim and £50. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you.
Because you get Hoshy through Apple's App Store:
We may update these Terms for legal or regulatory reasons, for security or safety, to reflect new or changed features, or to correct errors. If a change is material, we'll give you at least 30 days' notice by email or in the app before it takes effect, and you can stop using Hoshy and cancel any subscription (via Apple) before then. Using Hoshy after the effective date means you accept the updated Terms. Earlier versions are available from us on request.
These Terms are governed by the laws of England and Wales. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live. Disputes may be brought in the courts of England and Wales; if you live in Scotland, Northern Ireland, or another country, you may also use your local courts.
If part of these Terms turns out to be invalid, the rest still applies. These Terms, together with the Privacy Policy, are the whole agreement between us about Hoshy — but nothing in them limits liability for fraud or affects your statutory rights. We may transfer this agreement to a successor or affiliate provided your rights aren't reduced; you may not transfer it. If we don't enforce something right away, we can still enforce it later. Other than Apple (section 16), no one else has rights under these Terms.
